Our goal is to facilitate the discovery of research for Members while providing Partners with a streamlined way to recruit participants for their studies and opportunities.

By using the Website, Services, or signing up as a Member or Partner, you expressly agree to this Agreement and the incorporated Policies. ClinicalConnection reserves the right to deny or terminate Membership or Partner access at its sole discretion.

For Members (Users seeking clinical trials and health related opportunities):

We help you explore clinical trial and other health related opportunities so you can share your contact information with study coordinators, researchers, or other partners that are seeking participants for follow-up if you apply.

As a member, you can browse a variety of clinical trials and other opportunities. You can sign up to express interest in learning more or participating in studies or opportunities that align with your personal preferences. You understand that ClinicalConnection may share your contact details with authorized research sites and sponsors (our partners) who may contact you regarding participation in specific clinical trials, research, or health related opportunities that you express interest in. These partners are permitted to contact you directly using the communication methods you provided, including email, mail, phone, and text, for purposes related to your interest in their clinical research studies or other opportunities. To join ClinicalConnection as a Member, you will need to provide certain Personal Data, such as your name, email address, phone number, residential address, birth date, and conditions of interest. Once you sign up and express interest in a specific listing, your information will be shared with the Partner to determine your eligibility. Signing up does not guarantee that you will be contacted or are qualified.

For Partners (Users seeking participants or patients):

We provide a comprehensive listing service that connects partners to potential participants (Members) who have expressed interest in clinical research or other health related opportunities.

Partners use ClinicalConnection to post information about their clinical trials, research, or health related opportunities and connect with Members who may qualify for their listed opportunities. We require partners to handle member information responsibly and to use it only for purposes related to their relevant opportunity. Each study or opportunity listed on our platform has specific eligibility criteria determined by the Partner. ClinicalConnection provides Partners with tools to manage listings, connect with potential participants, and track recruitment efforts.


General Terms

Grant of License

Subject to your compliance with these Terms and Conditions, ClinicalConnection grants you a limited, non-exclusive, non-transferable license to access and use the Service solely for personal or professional purposes, in accordance with this Agreement. You may not modify, adapt, reproduce, distribute, display, or create derivative works of the Service or its contents without prior written consent from ClinicalConnection or its licensors.

Copyright, Licenses and Idea Submissions

ClinicalConnection is a registered service mark. Other trademarks and service marks appearing on the Service may be owned by other parties including third parties not affiliated with ClinicalConnection. The entire contents of the Service are copyrighted as a collective work under the United States and other copyright laws. ClinicalConnection holds the copyright in the collective work. The collective work includes works which are the property of ClinicalConnection's Licensors which are also protected by copyright and other intellectual property laws. You may display and, subject to any expressly stated restrictions or limitations relating to specific material, download portions of the material from the different areas of the Service solely for your own non-commercial use. Any redistribution, retransmission or publication of any material is strictly prohibited without the express written consent of the copyright owner. You agree not to change or delete any proprietary notices from materials downloaded from the Service. You agree to grant to ClinicalConnection a non-exclusive, worldwide, royalty-free, perpetual license, with the right to sublicense, to reproduce, distribute, transmit, create derivative works of, publicly display and publicly perform any materials and other information (including, without limitation, ideas contained therein for new or improved products or services) you submit to the Service by all means and in any media now known or hereafter developed. You agree that you shall have no recourse against ClinicalConnection for any alleged or actual infringement or misappropriation of any proprietary right in your communication to us.

Indemnification

You agree to indemnify, defend, and hold harmless ClinicalConnection, its officers, directors, employees, agents, and affiliates from and against any claims, damages, liabilities, costs, and expenses, including reasonable attorneys' fees, arising out of or relating to (i) your use of the Service; (ii) any violation of this Agreement by you; or (iii) any infringement of intellectual property rights or other rights of any third party arising from your actions.

Third Party Rights

The provisions of paragraphs (Review) and (Indemnification) are for the benefit of ClinicalConnection and its officers, directors, employees, agents, suppliers and Licensors. Each of these individuals or entities shall have the right to assert and enforce those provisions directly against you on its own behalf.

Arbitration and Dispute Resolution

Any disputes, claims, or controversies arising out of or in connection with this Agreement or the Service shall be resolved by binding arbitration, rather than in court. The arbitration shall be conducted by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. Nothing in this arbitration clause shall prevent either party from seeking injunctive or equitable relief from a court of competent jurisdiction to protect its intellectual property rights or enforce any other provision of this Agreement. You agree that any disputes will be resolved individually, and not as part of a class action or collective action. The arbitrator shall have no authority to consolidate claims or to award class-wide relief.

Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. You agree that any legal action or proceeding between ClinicalConnection and you for any purpose concerning this Agreement or the parties' obligations hereunder shall be brought exclusively in a court of competent jurisdiction sitting in Miami-Dade County, Florida. Any cause of action or claim you may have with respect to the Service must be commenced within one (1) year after the claim or cause of action arises. ClinicalConnection's failure to insist upon or enforce strict performance of any provision of this Agreement shall not be construed as a waiver of any provision or right. Neither the course of conduct between the parties nor trade practice shall act to modify any provision of this Agreement.

Waiver

Failure by ClinicalConnection to enforce any provision of this Agreement shall not be construed as a waiver of any provision or right.

Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. ClinicalConnection makes no representations or warranties of any kind, express or implied, regarding the operation of the Service or the accuracy, completeness, or reliability of any content or materials contained therein.

Assignment

ClinicalConnection may, at its sole discretion and without prior notice to you, assign, delegate, or otherwise transfer any or all of its rights, interests, and obligations under this Agreement to a third party, including in connection with a merger, acquisition, corporate reorganization, sale of assets, or by operation of law. You may not assign or transfer your rights or obligations under this Agreement without the prior written consent of ClinicalConnection, and any attempt to do so without such consent shall be null and void.

Limitation of Liability

To the fullest extent permitted by applicable law, ClinicalConnection shall not be liable for any indirect, incidental, consequential, special, or punitive damages, or any loss of profits, data, or goodwill arising out of or in connection with your use of the Service, even if ClinicalConnection has been advised of the possibility of such damages. In no event shall ClinicalConnection's total liability to you for all claims arising out of or relating to this Agreement exceed the amount you have paid ClinicalConnection for the Service during the 12-month period immediately preceding the claim. ClinicalConnection may assign its rights and duties under this Agreement to any party at any time without notice to you.

Term; Termination

This Agreement becomes effective when you access the Service and/or complete the registration process. Either party may terminate this Agreement at any time: ClinicalConnection may suspend or terminate your access to the Service without notice for any reason, including violations of these Terms or Operating Policies.You may terminate at any time by notifying ClinicalConnection and ceasing all use of the Service. Upon termination by either party, you must immediately discontinue any and all access to and use of the Service, and any rights or licenses granted to you under this Agreement shall immediately terminate. Termination does not affect any rights or obligations that accrued prior to termination, including any outstanding payment obligations, active listing fees, or other responsibilities under these Terms. The following provisions will survive termination: Disclaimer of Warranties, Limitation of Liability, Copyright, Licenses and Idea Submission, Indemnification, Third Party Rights, Governing Law, Arbitration and Dispute Resolution, and any other provisions which by their nature are intended to survive termination.

Notice

ClinicalConnection may deliver notice to you under this Agreement by means of electronic mail, a general notice on the Service, or by written communication delivered by mail to your address on record in ClinicalConnection's account information. You may give notice to ClinicalConnection at any time via electronic mail to ClinicalConnection or by letter delivered by first class postage prepaid U.S. mail or overnight courier to the following address:

Operating Policies

These Operating Policies govern your use of the Service. By accessing or using the Service, you agree to adhere to these policies. Failure to comply with any of these policies may result in the suspension or termination of your access to the Service and, depending on the nature of the violation, may result in legal action against you. These policies are in place to ensure a safe, respectful, and lawful environment for all users.

  1. Eligibility and Account Registration

    Certain features of the Service may require you to create an account. You must be at least 18 years old to use the ClinicalConnection Service. By accessing or using the Service, you represent and warrant that you meet eligibility requirements. You agree to provide accurate, current, and complete information and to maintain and update this information to ensure its accuracy. If there are any changes to the information you provided during registration, such as changes to your name, address, or other contact details, you agree to promptly notify ClinicalConnection and update your account information. If you are using the Service on behalf of an entity, you represent and warrant that you have the authority to bind that entity to these Terms and Conditions.

  2. Use of Real Identity

    Users are prohibited from posting or transmitting any content anonymously or under a false name. You may not allow any third party (other than an authorized agent acting on your behalf and under your supervision) to use your account or access the Service.

  3. Submitting Interest on Behalf of Another Individual

    Parents, legal guardians, or authorized caretakers may submit interest forms and related information on behalf of individuals under their care, including minors or adults unable to complete the form themselves. By submitting information on behalf of another person, you confirm that you have the legal authority to do so and that the individual, where applicable, has consented to participation or contact. ClinicalConnection may follow up with either the individual or their authorized representative, as appropriate.

  4. Prohibited Activities

    By using the Service, you agree not to engage in any activities that harm, disrupt, or otherwise violate the rights of ClinicalConnection, its users, or its systems. Prohibited activities include, but are not limited to:

    • Engaging in illegal, fraudulent, or harmful activities, including phishing, spamming, distributing malware, initiating cyberattacks, or any other unlawful behavior.
    • Posting or transmitting content that is defamatory, obscene, offensive, harassing, harmful, or that violates the rights, privacy, or dignity of others.
    • Violating the intellectual property rights of ClinicalConnection or any third party, including unauthorized use of copyrighted materials, trademarks, or proprietary information.
    • Interfering with or disrupting the proper operation of the Service, such as overloading servers, introducing harmful code, attempting to bypass security features, or compromising the integrity of ClinicalConnection's systems.
    • Attempting to gain unauthorized access to ClinicalConnection’s database, servers, accounts, or user data, including any restricted areas of the Service.
    • Transmitting files containing viruses, worms, Trojan horses, or other destructive code that could harm the Service or other users' devices.
    • Sending spam, unsolicited messages, or engaging in any behavior that disrupts or diminishes the experience of other users.
    • Engaging in activities designed to disrupt, undermine, or harm the functionality or usability of the Service for ClinicalConnection, its users, or third parties.
    • Posting or transmitting unauthorized advertising, promotional materials, charity requests, petitions, chain letters, pyramid schemes, or multilevel marketing content, unless specifically authorized by ClinicalConnection.
    • Using the Service to solicit unlawful activities or conduct that violates the rights of ClinicalConnection or its users.

    Any attempt to access ClinicalConnection’s systems, database, or servers for unauthorized purposes, including but not limited to data scraping, hacking, or any nefarious intent, is strictly prohibited. Such actions constitute a violation of this Agreement and will result in immediate termination of access, as well as potential legal action, including criminal prosecution.

  5. Equipment

    To access and use our services, you are responsible for obtaining and maintaining all necessary devices, internet connections, and communication services (such as email, phone, and text). ClinicalConnection is not responsible for any limitations or failures caused by your equipment or service providers.

  6. Account Access and Security

    When you register for the Service, you will be required to select a User ID and password. You are responsible for maintaining the confidentiality of your account credentials, and you agree not to share or disclose your account information with others. ClinicalConnection reserves the right, at its sole discretion, to reject or modify any User ID you choose for any reason. While we implement reasonable safeguards to protect your account and personal information, you are also responsible for keeping your login credentials and equipment secure and are solely responsible for all activities that occur under your account. It is your responsibility to ensure that your devices are free from malware, viruses, or other security threats that could compromise your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security. We are not responsible for any losses or damages arising from your failure to protect your own account information.

  7. Security Restrictions

    You are strictly prohibited from engaging in any activities that compromise the security, integrity, or functionality of the Service or its underlying systems, including the database. Specifically, you may not:

    • Attempt to access, retrieve, or manipulate data from the Service’s database without proper authorization. This includes activities such as data scraping, mining, or unauthorized querying of the database for any purpose.
    • Reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code, algorithms, or underlying architecture of the Service.
    • Use the Service in any unlawful manner or for any purpose that violates applicable laws or regulations, including those pertaining to data privacy and security.
    • Distribute, rent, lease, sublicense, sell, or otherwise transfer access to the Service or its features to any unauthorized third party.
    • Circumvent, disable, or interfere with any security features, access controls, or usage restrictions implemented within the Service.
    • Introduce or attempt to introduce any malicious software, scripts, or other harmful components, such as viruses, worms, or Trojan horses, that may compromise the database or disrupt Service operations.

    ClinicalConnection reserves the right to monitor usage for compliance with these terms and to take appropriate actions, including account suspension, termination, or legal action, against individuals or entities that violate these restrictions. Unauthorized access or activities may result in criminal prosecution and civil liability.

  8. Online Communications

    Participation in online communications, including but not limited to chat rooms, discussion boards, forums, and other similar areas, related to ClinicalConnection is subject to moderation. ClinicalConnection retains the right to monitor and moderate all content posted to the Service, as well as any content shared on third-party platform accounts in relation to ClinicalConnection. You agree not to post or transmit any content that ClinicalConnection deems, in its sole discretion, to be:

    • Abusive, defamatory, or obscene
    • Fraudulent, deceptive, or misleading
    • Offensive, objectionable, or otherwise unacceptable
    • In violation of the intellectual property rights of others
    • Violating any of the Operating Policies outlined herein

    Content that violates these policies may be removed at ClinicalConnection's discretion, and the offending user may face suspension or termination of their access to the Service.


Communication Channels Terms

As part of our Services, ClinicalConnection may contact you using various communication channels, including email, direct mail, and SMS, based on the contact information you provide and your expressed preferences. By submitting your information and opting in where applicable, you give explicit consent to receive informational communications through these channels.

Email

ClinicalConnection provides informational email notifications as part of its Services. By subscribing, you provide explicit consent to receive informational email communications from ClinicalConnection at the email address you provide. These emails may include updates related to research opportunities or services offered through ClinicalConnection. You must provide a valid email address that you own or are authorized to use. You may withdraw your consent and unsubscribe at any time by clicking the unsubscribe link found in the footer of each email. ClinicalConnection is not responsible for delays, delivery failures, or errors in email communications caused by issues outside of our control, including but not limited to email provider outages, user-side filtering, or changes to your email address. Standard internet or data usage rates may apply depending on your service provider.

Direct Mail

If you provide a physical address and express interest, you may receive direct mail communications related to research or healthcare services. By submitting your contact information and expressing interest, you give explicit consent to receive mail at the physical address you provide. These mailings are intended to inform you of relevant research or healthcare-related opportunities based on the information you submit. ClinicalConnection is not responsible for delays, delivery failures, or lost mail caused by postal service issues or incorrect address information. You may request to be removed from future mailings by contacting us directly.

SMS

ClinicalConnection provides informational text notifications as part of its Services. By selecting the box to Receive text messages, you provide explicit consent to receive informational SMS notifications from ClinicalConnection at the mobile number you provide. You must be the owner or authorized user of the mobile number submitted. These text messages may include updates related to your interest in clinical research opportunities or the services offered through ClinicalConnection. Standard message and data rates may apply depending on your mobile carrier. You may opt out of receiving SMS messages at any time by replying STOP to any message. For assistance, reply HELP or email us at info@clinicalconnection.com. Message frequency may vary. Mobile carriers are not responsible for delayed or undelivered messages.


Listings and Billing Terms (For Partners)

This section outlines the terms governing the creation, management, and termination of listings, as well as billing and payment policies on ClinicalConnection, specific to Partner users. These terms apply to all listings submitted by partners and the associated financial responsibilities.

Listing Terms

After submitting a listing, it will undergo a review process that may take up to two business days. Once the listing is approved and live, you will receive an email confirmation containing a link to view the listing. Please note that all listings are subject to auto-renewal at the end of each billing cycle unless canceled through your partner dashboard before the next renewal date.

  • Listings containing offensive language, imagery, or material that violates applicable laws or ClinicalConnection's content guidelines will not be approved.
  • Provided images added to listings must be in JPG or PNG format and cannot contain phone numbers, email addresses, URLs, QR codes, or other methods of direct contact. All images must be submitted to info@clinicalconnection.com and include the Study ID in the message; failure to do so may result in the image not being associated with the correct listing.
  • As the listing party, you are responsible for ensuring that the content you post complies with Institutional Review Board (IRB) standards. ClinicalConnection is not liable for any content that does not meet these standards.
  • ClinicalConnection reserves the right to edit or remove any content within a listing, including titles, descriptions, and outbound messaging, to ensure compliance with these Terms and Conditions. ClinicalConnection reserves the right to terminate a listing at any time, for any reason, at its sole discretion.

If any issues arise during the listing approval process, such as incomplete details, formatting problems, or conflicts with listing standards, we may contact you using the user information provided to help guide and resolve the issue. Our goal is to ensure your listing is accurate, effective, and meets platform standards. While we strive to process listings and billing actions promptly, holidays, system maintenance, and other unforeseen disruptions may cause delays. We appreciate your understanding and will make every effort to minimize any impact on your experience.

Performance and Targeting

ClinicalConnection does not guarantee the number of referrals or results generated by your listing. Performance is influenced by a variety of factors, many of which are outside of ClinicalConnection’s control, including, but not limited to, geographic location, the quality of the listing content you provide, enrollment practices at the site level, and response time to referrals. Delays in follow-up, inconsistent enrollment processes, or operational limitations at the site level may negatively impact the success of a campaign.

Each listing is targeted separately based on its specific criteria and intended population. It is possible for multiple listings targeting the same or overlapping populations to receive referrals from the same potential participants. Excessive or high-frequency targeting of the same population with multiple or redundant listings may lead to database fatigue and reduce overall referral effectiveness. To maintain database integrity and optimize referral quality, ClinicalConnection recommends careful management of listings to avoid excessive overlap or redundancy.

For listings utilizing the Clinical Ad Network, ClinicalConnection may employ various advertising channels. If you have specific preferences for exclusion of certain channels or targeting criteria, you must notify us in advance. However, ClinicalConnection retains discretion over the methods and channels used.

Listing Cancellations

Cancellations and setting future end dates must be completed through the partner dashboard. It is your responsibility to manage and cancel listings or set future end dates. Requests submitted via email or phone will not be accepted as valid attempts to end listings. While we strive to process all dashboard actions promptly and accurately, occasional errors or processing delays may occur. If you believe a cancellation was not processed correctly, we encourage you to contact us as soon as possible. We are committed to working with you to address and resolve any such issues in good faith.

Content Ownership and User Contributions

You retain ownership of the content you post, upload, or otherwise contribute to the Service ("User Content"). However, by submitting User Content, you grant ClinicalConnection a worldwide, royalty-free, sublicensable, transferable, and perpetual license to use, copy, modify, distribute, display, and otherwise use the User Content for any purpose in connection with the Service. ClinicalConnection reserves the right to remove or modify any User Content that violates this Agreement or is deemed inappropriate at our sole discretion.

Prohibited Content

You agree not to post, upload, or transmit any content through the Service that violates applicable laws, infringes on the rights of others, or fails to follow proper legal processes for handling sensitive information. Prohibited content includes, but is not limited to:

  • Content that is libelous, defamatory, or discloses private, personal, or sensitive information about any individual without explicit consent or legal authorization.
  • Material that is indecent, obscene, sexually explicit, or pornographic in nature, or that otherwise violates community standards or laws regarding acceptable content.
  • Content that infringes on the intellectual property rights of ClinicalConnection or any third party, including unauthorized use or distribution of copyrighted materials, trademarks, trade secrets, or other proprietary information.
  • Data, information, or materials related to sensitive, restricted, or legally protected topics without proper authorization or compliance with relevant legal processes.
  • Content intended to mislead, harm, or deceive others, including fraudulent claims, false information, or malicious representations.

ClinicalConnection reserves the right to remove, restrict, or block any content deemed to violate these terms or that poses a risk to the legal integrity of the Service, its users, or other stakeholders. Violators may face immediate account suspension, termination, or legal action, as appropriate.

Billing Terms

By selecting a pricing plan and posting a listing, you agree that your service will automatically renew every 30 days at the rate specified at the time of purchase until canceled through your partner dashboard. Failure to pay any amount due will result in termination of access to the Service.

ClinicalConnection will issue invoices based on the pricing plans you have selected, and the listings associated with your account. Invoices will reflect the correct fees in accordance with your current listings and plans. It is your responsibility to validate that the information regarding your selected plans and the number of active listings is correct. Invoices will show the payment method used or indicate if payment is still due. The following outlines important billing terms and procedures related to your account:

  • You must provide a valid payment method. If the payment fails, your listing will be suspended until payment is successfully processed. ClinicalConnection reserves the right to suspend or terminate services for unpaid balances. Credit card payments are the primary method of payment for services provided by ClinicalConnection. In certain cases, we may accept ACH or check payments, but this option is limited and subject to approval. ClinicalConnection reserves the right to determine eligibility for alternative payment methods, including ACH and check, at our sole discretion. Invoices will be processed and charged based on the payment method selected or determined by ClinicalConnection.
  • You authorize ClinicalConnection to charge your payment method(s) for the full amount of the invoice, which will be based on the selected pricing plan and the volume of active listings. We will do our best to provide accurate billing and timely invoicing; however, ClinicalConnection reserves the right to charge your payment method for any addtional outstanding balances—regardless of age—at any reasonable time after you update your payment method. For significant charges, we will make reasonable efforts to notify you prior to processing the payment. It is your responsibility to review and confirm the accuracy of these charges. If there are any discrepancies, adjustments will be made in subsequent invoices.
  • If your payment fails, we may provide a short grace period at our discretion, but you are still responsible for any charges. It’s up to you to ensure your payment method is current and to cancel through the proper channels. A declined or missed payment does not automatically cancel service, and fees may continue to accrue. You must update your payment method or cancel properly to avoid continued fees.
  • If a listing is activated mid-cycle, you will be charged a prorated fee based on the number of days the listing is active during the current billing cycle. The prorated charge will be calculated and applied accordingly, and upon renewal, you will be billed for the full amount for the next billing cycle. If you cancel a listing before the end of a billing cycle, the full 30-day fee will still apply, and no prorated refund will be issued. ClinicalConnection does not provide prorated billing for listings that are canceled mid-cycle.
  • The payment term for credit card payments is net 0, meaning payment is made immediately upon invoicing. For ACH and check payments, standard payment term is net 10, meaning payment is due within 10 days from the date of the invoice. ACH and check payments will be considered timely if received within this period. If payment is not received within 10 days, late fees may be applied as outlined in the billing terms above. ClinicalConnection reserves the right to suspend or terminate services, including any active listings, if payment is not received by the due date.
  • Late fees will accrue on any unpaid balances that are more than 30 days old. The late fee will be assessed at a rate of 1% per month (12% annualized) and will continue to accrue until the outstanding balance is paid in full. It is the responsibility of the account holder to ensure timely payment to avoid these charges.

Promotions and Discounts

From time to time, ClinicalConnection may offer promotional pricing, discounts, special offers, or other limited-time incentives (“Promotions”) as part of its Services. All Promotions are offered at the sole discretion of ClinicalConnection and are subject to change or termination at any time without notice. All Promotions are subject to these Terms and any additional terms presented at the time of the offer.

Unless explicitly stated otherwise in writing, promotional offers are single-use only and may not be combined with other offers or discounts. If multiple promotions are applied or attempted, the first or established and active promotion at the time of acceptance will override any additional or subsequently submitted offers. A new or alternative promotion will only be applied if expressly agreed upon in writing by ClinicalConnection and confirmed as a replacement to the original offer.

Promotions are not guaranteed and may not be available to all users. ClinicalConnection reserves the right to:

  • Modify, suspend, or discontinue any Promotion at any time for any reason;
  • Limit eligibility or the duration of any Promotion;
  • Deny promotional pricing to users who do not meet the stated criteria;
  • Prevent misuse or abuse of Promotions, including fraudulent or duplicate claims.

Promotional terms do not establish any right to future discounts, legacy pricing, or extended benefits beyond the explicitly stated period of the Promotion. No Promotion shall be interpreted as a commitment to provide ongoing or recurring discounts.

Credit Card Payments

By using ClinicalConnection’s recruitment services, you authorize ClinicalConnection or its designated payment processor to charge your credit card for all applicable fees, charges, and costs associated with the services you select. Your payment information, including credit card details, will be processed and stored in compliance with applicable industry standards, including the Payment Card Industry Data Security Standard (PCI DSS) through secure third-party payment processing services. All charges will appear on your credit card statement under the descriptor associated with ClinicalConnection and/or its payment processor. Please note these conditions apply to all credit card transactions:

  • By providing your credit card information, you warrant that you are the authorized cardholder or have the express authorization of the cardholder to use the card for this purpose. You are responsible for ensuring that your payment method is valid, current, and has sufficient funds or credit available to cover all charges.
  • If a charge is declined or payment cannot be processed for any reason, ClinicalConnection reserves the right to suspend or terminate your access to the Service until the outstanding balance is resolved. You remain responsible for any unpaid amounts and may incur additional fees related to failed payments or collections.
  • When your credit card information is updated, any outstanding balances will be automatically charged to the new payment method on file. You expressly authorize ClinicalConnection to charge the full amount of any unpaid balance on your account. This includes any fees, charges, or amounts due for services rendered or subscriptions initiated through the platform.

If you believe there is an error or discrepancy in the amount charged, you must contact ClinicalConnection at billing@clinicalconnection.com within 30 business days of the charge date to dispute the transaction. Failure to dispute within this timeframe constitutes acceptance of the charges.

ACH (Wire Transfers and Direct Deposit) Payments

By using the ACH payment method, you consent to ClinicalConnection processing payments from your bank account as per the agreed schedule. You may revoke your authorization to pay via ACH by providing written notice to ClinicalConnection at least ten (10) business days before the next scheduled payment. Please note that cancellation of ACH authorization does not relieve you of any outstanding balances owed to ClinicalConnection.

You are solely responsible for ensuring that your ACH payment is made on time and that there are sufficient funds in your account. ClinicalConnection is not liable for any delays, errors, or fees incurred due to insufficient funds, incorrect account information, or actions taken by your bank. If an ACH payment fails, you will be responsible for any fees or penalties, and ClinicalConnection reserves the right to suspend services until the balance is paid in full.

Check Payments

All checks must be made payable to “ClinicalConnection, Inc”. Please note that payments made via check may take longer to process than electronic payments, and services will be activated once the check has been received, cleared, and processed. Payments made via check may take 2 weeks or more to process. If there is an additional delay in the processing of your check, your access to services may be temporarily suspended until the payment is fully processed.

You are responsible for ensuring that sufficient funds are available to cover the check payment. If a check is returned for insufficient funds or other issues, ClinicalConnection reserves the right to charge a processing fee and may suspend or terminate your access to the service until payment is made. Payments via check are subject to the same refund policy as other forms of payment.

Refunds and Chargebacks

At ClinicalConnection, we are committed to providing transparent and fair policies regarding refunds. By using our services, you acknowledge and agree to the following refund terms:

  • Refunds are generally not provided for services once they have been initiated or listings have been made live. All sales and payments are considered final unless explicitly stated otherwise in this policy or required by applicable law.
  • If a listing is activated mid-billing cycle, charges will be prorated as described above for the portion of the cycle during which the listing is active. However, refunds will not be issued for listings canceled before the end of the billing cycle. ClinicalConnection may offer a refund at its discretion. This refund will only be available within a brief grace period following the start of the billing cycle, before any outreach has been sent. After this period, no refunds will be provided for that billing cycle.
  • Any request for a refund must be made in writing via email to ClinicalConnection’s support team. Requests must include your full name and account information and the reason for the refund along with any relevant supporting documentation. Refund requests will be reviewed on a case-by-case basis, and ClinicalConnection reserves the right to approve or deny any request at its sole discretion.
  • If you believe a billing error has occurred, you must notify ClinicalConnection in writing within 30 days of the charge. ClinicalConnection will investigate and, if a valid error is confirmed, will issue a refund or credit to your account.
  • Any chargebacks or disputed payments submitted through your financial institution without first attempting to resolve the issue with ClinicalConnection may result in suspension or termination of your account.

Acceptance of Terms

By accessing, using, or interacting with the Service, you confirm your understanding of and agreement to be bound by these Terms and Conditions, including the disclaimer below and any future amendments or modifications. This Agreement shall commence upon your accessing the Service and/or completing the registration process. This Agreement, together with our Privacy Policy and any other legal notices or agreements published on the Service, constitutes the entire agreement between you and ClinicalConnection regarding the use of the Service. This Agreement may be terminated by ClinicalConnection without notice at any time for any reason and may be terminated by you upon notice to ClinicalConnection at any time for any reason. The provisions of the terms and conditions and the disclaimer set forth shall survive any termination of this Agreement. If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. If you do not agree to these terms or these terms become terminated through ClinicalConnection or yourself, you are prohibited from using or accessing the Service.
